Biden's new “Parole in Place” program to keep families together is on pause. A Texas judge has halted the processing of applications. Last week the governors of several states including Governor Abbott of Texas filed a lawsuit against the federal government to stop the program created to grant lawful permanent residency to spouses and stepchildren of U.S. citizens, as I have reported to you in recent articles.

The Republicans, a supposedly pro-family party, with this lawsuit are once again demonstrating their hypocrisy with the argument, which to me is quite funny, that this program is encouraging more people to cross the border without permission to receive this kind of benefit. This argument seems ridiculous to me. I don't think there are people abroad having coffee thinking about coming to the United States because they hear about this program and think if we go and marry U.S. citizens maybe in 10 years we can apply for legal residency, this argument has no logic, but again it is an example of the hatred and racism of the Republican party that is screaming that this program is some kind of amnesty that will supposedly cause a large “invasion” of immigrants.

Judge J. Campbell Barker appointed in 2019 by then President Donald Trump and known to be very conservative, has made the decision to stop the processing of the cases for the next 14 days starting August 25, but in the meantime applicants can continue to submit their applications online through the USCIS page, but they should understand that they will not be processed or approved while the court decides what they will do with the program.

Let's remember that something similar happened with the legal processes and court challenges of the DACA program at the time and which is still in effect and the Parole case for Venezuelans, Haitians and Cubans which for now is suspended by the USCIS.

In my opinion most likely the program will be approved in the courts but for now we do not know and it may take some time while several federal courts give their opinion, for example if the federal government loses the case with this judge they will appeal the decision to the appeals court and in case the judge decides that the program can go forward the republican governors will also file an appeal to the higher court. The judge has also said he will try to make the review process a little faster, for now we don't know what will happen.

For the people who already applied there is no problem, their cases will remain in the system but for now they will not be processed or approved until it is decided in federal court. For now we have to keep pending on what the Texas court will decide, but we should not lose faith, I think there is still a very good chance that this program will continue especially if Kamala Harris wins in the November elections, it is important that we keep pending on the judge's decision in 14 days and do not lose faith even though the program may take some time.

I am advising people who qualify for this program to continue to gather the documents to prove their presence for at least the last 10 years in the United States, if you want more information on the program you can call our office.

Again the program is limited to spouses, present for at least 10 years in the United States before June 17, 2024 or stepchildren of citizens under the age of 21 before June 17, 2024.

We are staying optimistic that the judges will finally do the right thing and allow this program to work and help unify families and not let the Republicans with their xenophobia and hatred cause more suffering to immigrants.
